By using this Site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the terms and conditions set forth below. If you do not agree to these terms and conditions, please do not use this Site and please do not submit any orders for products or services. These terms and conditions may be changed by californiacomputer.com in the future. It is your responsibility as a user to periodically return to this page to review the terms and conditions for amendments. The amended terms shall take effect automatically the day they are posted on the site. Your continued use of the californiacomputer.com web site following any amendments will constitute agreement to such amendments.
In instances where a particular brand of memory is not available, californiacomputer.com reserves the right to ship a memory of equal quality, though different brand, which will have the same specifications and functionality as does the ordered item. This insures that you will receive your order promptly, and will not result in any disadvantages to you whatever.
Prices on this invoice do not include installation, training or support, unless otherwise specified on the face of this document. Entire agreement: the agreement contains the entire agreement between the parties hereto. No promise, representation, warranty or covenant not included in this agreement has been or is relied on by either party. Each party has relied on its own examination of this agreement and the provisions hereof, and the counsel of its own advisors.
To our valued customers, a word about our low prices
It has happened so often, that we feel it must be addressed. Many of you have contacted us, asking with some suspicion how our prices can be so low. Are we selling defective products? Used? Refurbished? No, no, and no*. Unlike pricier merchants who provide (and charge for) post-sale perks, we are committed to offering great products at fantastic prices. As a web-based store, we do not have the huge costs associated with a traditional retail store, and this allows us to offer excellent pricing. Some of the items we offer are available only while supplies last; and often, we will not be able to re-purchase them at our current selling price. Our products are fully backed by manufacturer warranties, but do not come with the support that may be available had they been purchased at higher prices. Our sales are final, and those dissatisfied with the quality of the merchandise will be asked to contact the manufacturer.
THE FAILURE OR REFUSAL OF EITHER PARTY TO INSPECT THE AGREEMENT OR OTHER DOCUMENTS OR THE FAILURE TO OBTAIN LEGAL OR OTHER ADVICE RELEVANT TO THIS TRANSACTION CONSTITUTES A WAIVER OF ANY OBJECTIONS, CONTENTIONS, CLAIMS THAT MIGHT HAVE BEEN BASED UPON SUCH READING, INSPECTION OR ADVICE. No modification or amendment to this agreement shall be of any force or effect unless in writing executed by the customer and authorized representative(s) of seller. This agreement is not assignable by the customer without the prior written consent of seller.

Purchaser’s order and this contract may not be terminated or canceled, either in whole or in part, without CCC written consent, and then only under terms that will reimburse CCC for all applicable costs incurred by it, including reasonable allowance for profit. Custom Configuration systems and special order items are final sale once the order is placed and deposit is giving order cannot be cancel. No refund on custom configuration systems deposit.

Please note: Canceling any order paid by credit card prior to shipping the merchandise will incur a 3% credit card charge. We are charged a 3% bank-processing fee for all transactions processed using our credit card terminal. That same fee will be assigned to any order cancelled after having been charged. When an order is placed and credit card information given, it is considered to be a solid order and your credit card will get charged unless the merchandise is not in stock.

CCC is not liable for any delay in performance due to unforeseen circumstances or due to cause beyond its control including, but not limited to, acts of government, labor disputes, delay in transportation, and delays in delivery or inability to deliver by CCC’s supplier.
We are not liable under any legal theory for consequential or incidental damages arising from shipping delays, system downtime, loss of data or for any loss, damage, or expense arising from product malfunction or defect (including, without limitation, year 2000 non-compliance in any software or hardware). We expressly disclaim all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. This disclaimer in no way affects the terms of the manufacturer’s warranty, if any. Other restrictions may apply.
Seller will in no event be liable for lost profits or other consequential damages even if seller or its representatives have been advised of the possibility of such damages or for any claim against the customer by any other party.

| Customer shall indemnify seller against and hold seller harmless from any an all claims, actions, proceedings, expenses, damages or liabilities including attorney's fees, arising in connection with the equipment, including, without limitations, its manufacture, selection, purchase, delivery, possession, use, operation or return and the recovery of claims under insurance policies thereon.

| In the event it becomes necessary for seller to enforce the terms and conditions of the agreement including seller's disclaimers and limitations of liability, seller shall be entitled to recover all of its costs incurred including reasonable attorney's fees in all manner of collection and in trail and appellate levels. In case of legal action customer is responsible for legal fees, lost of time to collect, all other expenses, and 10% annually interest to collect balance for an invoice or invoices.

If you receive damaged merchandise, it is best to REFUSE it back to the carrier attempting delivery. If you accept the package make sure it is noted on the carrier's delivery record in order for californiacomputer.com to file a damage claim. Save the merchandise and the original box and packing it arrived in, notify californiacomputer.com immediately to arrange for a carrier inspection and a pick up of damaged merchandise.
For your protection, we strongly recommend you fully insure your return shipment in case of loss or damage. Please use a carrier that is able to provide you with proof of delivery such as UPS or Fed Ex.

| Failure of customer to perform its obligations hereunder including, without limitation payment in full of the purchase price for the equipment or the insolvency, bankruptcy, assignment for the benefit of creditors, or dissolution, liquidation, or winding up of the business of customer shall constitute a default under this agreement, and shall afford to seller the right to immediately recover the equipment without notice to the customer in addition to all the remedies of a secured party under the uniform commercial code of the state of California.

In case customer’s check is not cleared for any reason or check is stopped for payment. CCC is authorized to charge customer’s credit card, that we have obtained for any reason in past, plus credit card charges in addition to $20 handling fee for each bounced or stopped check.

| Purchaser refusal to accept shipment of Goods from freight carrier for any reasons beyond the control of californiacomputer.com will incur a credit of *Current Market Price less a restocking charge of 15% of the invoice price and all freight charges (including loss or charges) Subsequent purchases will require written purchase order.
*”Beyond the control of CCC” includes but is not limited to: A) Unsuccessful delivery due to an incorrect address submitted during order, B) Refusal to accept a delivery when there is no legitimate reason for such a refusal. Legitimate reasons include, but are not restricted to: 1) Having cancelled the order in writing prior to shipment; 2) a package being tendered for delivery that has been materially damaged in transit. C) Unsuccessful delivery attempts due to an absence of a receiver who would sign for the delivery.

After placing your order you will receive confirmation e-mail with details of the order you just placed.
Prices shown do not include charges for shipping and handling or for applicable sales/use taxes. Customer is solely responsible for applicable shipping and handling charges and taxes. Unless Customer provides californiacomputer.com with a valid government or nonprofit tax exemption certificate, taxes will be charged for orders shipped to California state in which californiacomputer.com is obligated to collect and report such sales.
californiacomputer.com have chosen FedEx because we have found that the service and reliability is worth the difference in price. If the website is calculating an unusually high shipping rate in comparison to the amount or type of items that you are ordering, you can e-mail us sales@californiacomputer.com
Note: Credit Card Orders Only! If the shipping address is different from the billing address on your credit card, please call your credit card company and have them note the shipping address on the card. However, there may be a delay in processing your order for verification purposes.
Shipping Policy
For your convenience, we use the most reliable carriers suitable to your location to deliver your package in the shortest time. Shipping charges are automatically calculated based on your selected method of shipment when placing an order. The method of shipment you choose does not necessarily mean you will receive your order within the specified number of days. Please note that we count from the day we ship and not from the day you place your order. However, we guarantee that we attend to our customers on a first come first serve basis. Please take note that we do not ship on Saturdays, Sundays and Holidays. Orders placed after 10 a.m. PST Friday will ship the following Monday.
We maintain a vast distribution network covering the United States in order to speed up delivery time to our customers. If you order two or more items, they each may not be housed at the same location. In our effort to deliver your order immediately, you may receive two or more shipments if the items come from different distribution points. If for some reason you do not want your order shipped separately, please give us a call at
800-727-2522 and inform us of your preference after you place the order. Please expect a slight delay and an additional destination charge on your shipment. Although we ship to most areas served by our carriers, we do not ship to P.O boxes or particular international locations at this moment.
Will I be charged tax?

Shortages must be claimed within twenty four (24) hours of the time merchandise is received by customer.
Shipment of any products purchased are subject to CCC’s availability schedule. CCC shall make every reasonable effort to meet any delivery date(s) quoted or acknowledged. However, CCC will not be liable for its failure to meet such date(s).

All items have carry-in warranty unless specified otherwise. Carry-in means that customer shall bring item(s) to CCC for repair regardless of amount and date of purchase. Do not discard boxes and packing materials. Some items must be shipped to their authorized service center for purpose of warranty or non-warranty repair. It is best to ship them inside their original boxes. Warranty shall not apply to defects resulting from:
- Improper or inadequate maintenance by buyer;
- Buyer supplied software or interfacing;
- Unauthorized modification or misuse (installation of other software or hardware to cause the problem);
- Operation outside of the environment specifications for the product;
- Improper site preparation and maintenance.
Warranty set forth by each manufacturer is exclusive and no other warranty whether written or oral, is expressed or implied. CCC specifically disclaims the implied warranties of merchantability and fitness for a particular purpose. In no event shall CCC be liable for direct, indirect, special, incidental or consequential damages (including loss of profit or labor) whether based on contract, tort or any other legal theory. Opening or otherwise tampering with the system for any purpose including upgrading, by unqualified personnel may jeopardize all warranties.
Due to certain manufacturers' policies and the restrictions placed upon us, the following products may not be exchanged or returned to us under any circumstance - ALL SALES ARE FINAL. Defective products are repaired and replaced in accordance with these manufacturers' established policies. Please call these manufacturers directly for details on their specific return policies. Products from the following brands are accepted for repair only: including, but not limited to: Apple, Compaq, IBM, Lenovo Toshiba, Sony and Hewlett-Packard. californiacomputer.com may not accept returns for exchange, replacement or credit. If you receive a unit that is inoperable for any reason, you may contact us for information on warranty service through californiacomputer.com , the manufacturer direct or any authorized service center in your area.

All our unlocked phones are manufactured overseas and only carry international warranties.
Please choose wisely - all cellular phone sales are final - absolutely no return or refund.
Defective cellular phones can be exchanged only within 14 days from the shipping date. After 14 days, all defective items should be sent to the manufacturer for exchange or repair.
In case manufacturer repair or replacement is required, most defective units would need to be sent outside the U.S.
Internet, SMS, and e-mail functions may require a download to your cellular phone from the service provider in order to work properly. | |
